Obstacles to Berlin airport project eased - Times-Argus

Obstacles to Berlin airport project eased

By David Delcore TIMES ARGUS STAFF - Published: November 4, 2009

BERLIN – There are still some details to be worked out and permits to be amended, but the selectboard appears willing to reverse its earlier position banning trucks from hauling 150,000 cubic yards of fill excavated from E.F. Knapp Airport along the town-owned portion of Airport Road.

The work is part of an extensive taxiway and apron construction project at the Berlin airport. The issue of what will happen to the extensive fill material and what roads will carry the heavy dump truck traffic has sparked concerns in both Berlin and neighboring Barre.

Confronted with Pike Industries' proposal to reclaim and repave the 4.5-mile stretch of town highway located between Scott Hill Road and the Barre Town line, board members indicated a willingness to entertain the idea, provided Pike put the specifics of its proposal in writing.

Among other things board members want to know when the hauling will start next spring, how long it is expected to last, and how soon Pike will make good on its promise to reclaim the already-deteriorated road that would be subjected to a tremendous pounding if the new route is approved. Board members are also interested in how deep Pike plans to excavate the road during the reclamation project and the particulars of the repaving plan.

One unsettled issue that surfaced during Monday night's discussion involves whether the contractor hired to do the hauling for the federally funded airport upgrade would consider extending the reclamation project all the way to the entrance of Scott Hill Road. That would add perhaps 300 feet of paving to the work Pike has offered to perform at no cost to the town in order to allay concerns that surfaced in neighboring Barre when officials there learned that the permitted truck route runs right through the heart of their downtown.

Road Foreman Richard Tetreault said he wasn't concerned about Barre, but he was worried that the recently floated proposal stopped a few hundred feet short of where it should in his estimation.

"I wouldn't accept this unless you guys go past that entrance," he said of the Scott Hill Road intersection. "The 10-wheelers turning there is one of the biggest problems … pivoting on that pavement."

Although Pike representatives Jay Perkins and Mark Peloquin said the section of road in question was rebuilt by the state not long ago and would not be adversely affected by the truck trips, they agreed to look into the possibility of extending the post-hauling paving project.

With Berlin's blessing, Peloquin said Pike can pursue an amendment to its Act 250 land-use permit revising the truck route and enabling it to haul most of the fill from the airport to a site at the Bond Auto warehouse on Prospect Street Extension in nearby Barre Town.

"There are still some hurdles even if you folks approve it," he added.

Assuming Pike can address issues associated with wetlands on the Bond property and obtain the necessary permit amendment, the fill will be used as the base for a new community recreation field for Barre Town.

The compromise got a thumbs-up from a state Agency of Transportation official, who said it addressed Barre's concerns involving truck traffic through its downtown, has been endorsed by Barre Town, and would provide Berlin with a no-cost upgrade to a deteriorated stretch of road.

"We support Pike's proposal I can tell you that," Scott Fortney told the selectboard. "It seems like a good deal to me."

Fortney's observation came on a night when Perkins and Peloquin were quizzed about why an alternative that would have minimized the use of Airport Road – essentially hauling the fill across the street to land owned by developer Henry LaGue – was not pursued.

Though he did not name LaGue, Perkins said an "opportunistic" attempt to "take advantage of a permit situation" prompted Pike to look elsewhere.

"There was a tipping fee associated with dumping the fill there (LaGue's land)," he explained. "We would rather spend our money hauling it just a little bit further doing a repair job for the town and creating at … least the foundation for a ball field … than get into a quarter of a million dollars worth of tipping fees."

Still, Perkins acknowledged the Bond auto site was a significantly shorter trip than the one that would have involved driving through downtown Barre and up to Websterville.

"That's what creates the savings so that we can make the investment in the road," Perkins said.

Perkins agreed to provide the board with the information it requested before it meets in two weeks.

The board is expected to make a decision at that time.

In another road-related matter, board members were told that the federally funded reconstruction of Paine Turnpike from the four corners to the Montpelier city line is progressing on scheduled.

Town Administrator Jeff Schulz said state officials are confident construction money will be approved at the federal level by the Dec. 1 deadline and the town should be able to award a construction contract by Jan. 1 as required.

Schulz said the project will go out to bid in the next couple of weeks and if all goes as planned the road will be repaved early next summer.

Clinton woman accuses Stratford police, town of false advertising in ... - Bridgeton News

Posted: 04 Nov 2009 04:50 PM PST

By Jennifer Golson/The Star-Ledger

November 04, 2009, 7:37PM

STRATFORD -- The Stratford Police Department advertised the 2000 Honda Civic on eBay as a car that was missing a stereo and showing normal signs of age, but still in good condition.

It was enough to entice Kerry McTiernan to place a bid in the online auction and pay $4,049, hoping it would be a suitable ride for her son. Instead, her mechanics said it's not even safe, and the Clinton woman is suing the Camden County town and police.

In a complaint filed in Superior Court in Hunterdon County, McTiernan alleged breach of contract, legal or common law fraud and recision for refusing to refund her money for the seized vehicle, a total of $4,464 in damages.

The defendants "had an obligation to ascertain whether the car was at least reasonably safe to operate on the public streets and highways of the State of New Jersey and to insure that any mechanical or other defects in it were disclosed to any potential buyer," according to the lawsuit Harmon Lookhoff filed on her behalf in Flemington.

"The vehicle was determined by two professional auto repair facilities to be so defective that it could not be driven safely, and McTiernan was advised by them not to even try to move it once it was returned to her driveway," Lookhoff wrote.

One mechanic said the car had been in at least one accident, and the frame was severely damaged, which could lead to a loss of control at any time. Another mechanic thought someone had hit the car from the front and the rear.

Located nearly 12 miles away from Cherry Hill, the town of less than 7,300 residents rarely has seized vehicles for sale, said Borough Clerk John Keenan. While they have not been served with the complaint, they received a tort notice.

The town has twice used eBay to sell vehicles. The other vehicle was a fire truck. Buyers are warned the cars are sold as-is, he said.

The lawsuit says the car was advertised for a period of time before and including July 28, 2008. McTiernan was told she could view it on any day except Sunday, and the car could not be test driven for insurance reasons. Her daughter, Aileen McTiernan, went to see it, but no one was there to let her in, the lawsuit says.

"She came on a Sunday to look at the car, and there is no one here on a Sunday," Keenan said. He was sure an employee would have driven the car with her in it, he said.

The accidents and the compromised frame are not defects McTiernan could have readily discerned from a test drive, Lookhoff said in a phone interview.

The car was still titled and insured by the municipality when two Stratford police officers delivered it. One officer drove the car, and the second followed, and the town charged $50 for delivery exceeding 50 miles, Lookhoff said.

With about 89 million active users, eBay does not track how many police departments use the online marketplace to auction seized vehicles, said spokeswoman Evonne Gomez. Sellers with higher volume can participate in the "Condition Guarantee by Seller" program. Under that option, sellers guarantee that the vehicle's condition is accurately described. If not, the seller will fix the problem fee of charge, according to the website.

Under state statute, a police department must get permission from the local prosecutor's office to auction a forfeited vehicle, said Lisa Ryan, a spokesman for the state Department of Community Affairs. In recent years, online auctions have become more popular, she said. They are not required to have them inspected first.

"It is buyer beware, and the sale is usually without any warranty," she said.

Phoenix, which is the capital of Arizona and also popularly known as the capital of the "Snowbirds". Millions of people come to the Phoenix area during the winters to enjoy the winter and as such, many people drive their cars to Arizona, and also in winters, Arizona sees more traffic and cars than in summers. As the number of vehicles grows in Phoenix, need for Automotive Locksmith Services also is on the rise. Thus, Phoenix automotive locksmith services market is one of the most competitive markets in the US and as such, it includes, car lockout services, car ignition repair, replacement and reproduction of lost or stolen car keys, ignition re-key, car locks re-key, trunk lock re-key, broken key extraction, transponder key programming, remote programming, key fob programming as also, programming of VAT keys. It's very important to understand the differences between the automotive locksmith services to enable them to save time and money. Hence, Phoenix Locksmiths provide a wide range of automotive locksmith services in the Phoenix area.

The first and the most popular type of service for automotive locksmiths in Phoenix is car lockout since car lockout is the most common problem and it happens when people are in a rush and as such, forget the keys inside the car or the trunk. Car lockout is a relatively simple service however; it can turn into a big expense if it becomes impossible to open the car with the car lockout tools. In fact, the car should be taken to a dealer so that the dealer can make a new key for it. Whenever you are locked out of your car, never try to use a Slim Jim, coat hanger, or a ruler to open the vehicles. In fact, these tools can damage your vehicle.

In addition, another popular automotive locksmith service is ignition repair since all car ignitions are built with wafer tumblers and springs and the wear and tear of these parts is quite high over time. Sometimes, it is impossible to turn on the ignition switch due to worn out or broken wafers and in this situation, the ignition should be taken out and all wafers replaced. In some cases, it is also impossible to replace the wafers and the whole switch needs to be replaced. Ignition replacement can turn out to be an expensive affair since some ignitions are more complicated than others. So, do not try to replace your ignition by yourself that can damage your vehicle for sure; rather the repairs then can be really expensive. We can come to your aid as Phoenix Locksmiths provides ignition repair services in the Phoenix area.

The expanding Olive - Las Vegas Weekly

The expanding Olive

There's lots more of the GV Mediterranean hangout to love

Brock Radke

Wed, Nov 4, 2009 (1:20 p.m.)

Henderson's hummus and hookah hot spot is expanding. The Olive, which has been serving up Mediterranean fare and providing a nighttime hangout for flavored-tobacco aficionados since 2005, has taken over the neighboring space that housed a luxury auto-repair shop. Once the renovation is finished, the restaurant will be around 5,000 square feet, more than twice its current size.

This is not the first expansion, but it is the most substantial. The new space will be used almost entirely as a lounge, serving cocktails and comfort for hookah action. The existing space will be converted to a larger dining room, although the vibe will stay casual.

"We've been doing hookah since we opened, and this is really to accommodate that crowd," said Jay Sayegh, one of the Olive's owners. "This way we can keep things separate and still give everyone what they want."

The move makes sense; stop in on any given night and you'll find a bustling, mixed crowd. Young people come to smoke hookah (Jay Sayegh and his partner Nick Sayegh are cousins, which is how they came up with the name Cuzzins for their tobacco mixing and distributing business) and listen to a DJ spin urban tunes, while older groups take over the back lounge and share simple plates of hummus, falafel and babaganoush. The cuisine is much better than you'd expect from a suburban shopping-center storefront. In fact, it may be some of the best Mediterranean food in town (the family hails from Lebanon and Jordan). That quality explains why people keep coming back through troubled times. An early 2009 shooting in the parking lot didn't help, but the Olive soldiered on.

Jay Sayegh said there may be some special entertainment for the opening of the new, expanded lounge, and maybe later on down the road, menu additions like kabobs and spanakopita. "We're going to feel it out," he said.
